Pope says Church needs more freedom to help Cuba change

SANTIAGO DE CUBA, Cuba (Reuters) - Pope Benedict arrived in Cuba on Monday and told the government it had nothing to fear from the Catholic Church, asking for more freedoms to help the communist country in times of change.

Just three days after saying that communism no longer works in Cuba, the pope took a softer stance as he landed in the eastern city of Santiago de Cuba for a three-day trip aimed at boosting the Church's role on the island.

The 84-year-old German pope delivered a carefully worded, nuanced and balanced arrival address after he was greeted warmly by President Raul Castro, dressed in a dark suit, accompanied by a full Honor Guard and artillery gun salute.

He was less direct in his criticism of Cuba's one-party political system than he had been when speaking to reporters on Friday, although he did offer some thinly veiled phrases addressing Cuba's human rights record.

"I carry in my heart the just aspirations and legitimate desires of all Cubans, wherever they may be," he said, including the "sufferings" of prisoners and their families, a reference likely to be well received by political dissidents on the island as well as Cuban American exiles in the United States.

Visiting 14 years after Pope John Paul II's landmark trip to Cuba, Benedict called that trip, which was a highlight of improved Church-state relations after decades of hostility that followed the 1959 revolution, "a gentle breath of fresh air".

But he said that while great strides had been made in improving relations with the Church, "many areas remain in which greater progress can and ought to be made, especially as regards the indispensable public contribution that religion is called to make in the life of society".

Benedict, who visited Mexico over the weekend, is trying to cement the Church's recent gains in Cuba and offer more help in assuring that whatever transition comes is buffered by its social programs, such as care centers for the elderly and limited after-school and adult education programs.

Raul Castro, younger brother of Cuba's revolutionary leader Fidel, delivered a firm political lecture about the injustices of the United States' hostility toward Cuba, including the economic embargo, and the island's "tenacious resistance" to preserve its independence and "follow its own path."

Castro, who was raised as a Catholic, grasped both hands of the pope and briefly bowed before him as Benedict stepped onto the airport tarmac. When the wind blew the pontiff's white vestments around his head, the Cuban leader gently put them back across his shoulders.

The president later was in the front row as Benedict celebrated an open-air Mass for tens of thousands of people in Santiago's Revolution Square.

Raul Castro has used the Church as an interlocutor on issues such as political prisoners and dissidents, while moving forward with reforms to Cuba's struggling Soviet-style economy.

They include slashing a million government jobs and freeing up some sectors to small-scale private enterprise.

It has supported Castro's reforms and urged him to move farther and faster in modernizing Cuba, both economically and politically.

SALVO

Benedict fired an unexpected salvo on Friday when he told reporters on his plane that communism in Cuba had failed and a new economic model was needed, adding that the Church was willing to offer its help "to avoid traumas."

The Cuban government offered a diplomatic response to the Pope's criticism, saying that Cuba would "listen with all respect" to the Pope and welcomed "the exchange of ideas."

In what appeared to be an effort to balance his remarks, Benedict made an apparent dig at capitalist greed on Monday, blaming the global economic crisis on "the ambition and selfishness of certain powers which take little account of the true good of individuals and families."

Cuba is going through a key moment in its history, Benedict said, hinting that with the advancing age of the Castro brothers the island was "already looking to the future."

Echoing the words of Pope John Paul who in 1998 urged Cuba to "open itself up to the world," and "the world to open itself up to Cuba," Benedict also recognized that Cuba was making an effort to "renew and broaden its horizons."

Church officials say Benedict's schedule has not allowed for meetings with dissidents, who say Castro's government flouts human rights and suppresses their voices.

The dissident movement Damas de Blanco, or Ladies in White, a group of Catholic women that campaigns for the release of political prisoners, said it had been told by Cuban authorities to keep clear of the pope's Mass in Santiago.

"They are going to present the pope with a facade, not with the true Cuba," said Ana Celia Rodriguez, a 42-year-old mother of three who is planning to try to attend anyway.

"I really don't expect much change from the pope's visit. He'll see a Cuba that doesn't exist. My message for the pope is that he ought to see how things really are."

More than 70 members of the Ladies in White were detained briefly last week, fueling concerns that the government, which views opponents as mercenaries of the United States, might clamp down to prevent public demonstrations during the pope's stay.

While many Cubans complain about the socialist economy's failings, not everyone agrees with the Pope's bleak assessment of Cuban communism.

"We're so happy the Pope is coming, it makes us feel as though the world is noticing us," said Alejandro Linares, a 23-year-old university student from the eastern province of Guantanamo, a small image of revolutionary icon Ernesto 'Che' Guevara dangling around his neck.

"We want him to see our Cuba. We want him to see that we live pretty well here and that we want to be socialist, not capitalist."

Earlier on Monday, two airplanes arrived in Santiago from Miami carrying 310 mostly Cuban American faithful on a special Church-organized package to attend the papal Masses. The Miami pilgrims brought a message of reconciliation, said the Archbishop of Miami, Thomas Wenski. "It's important that we overcome the resentments and hatred of the past," he said.

Guest Blogger Kathleen Boozang: A New Insurance Product: Responsible Corporate Officer Defense Insurance

Boozang-176x220_1Unsurprisingly, the market has responded to the new risks corporate officials in the life sciences industry face if their companies commit crimes that threaten the public?s health.? On February 7, 2012 insurance broker Marsh USA and insurer Allied Assurance Co. unveiled a new product, called RCO Corporate Response, ?which provides insurance coverage for pharmaceutical, life sciences, and health care corporate officers who may be held liable for their companies? actions under the Responsible Corporate Officer (RCO) doctrine.??

For those who are rusty, The Responsible Corporate Officer Doctrine allows for the conviction of a high-level corporate official (ambiguity of terminology suggests that directors could be liable as well) whose company has violated the Food, Drug and Cosmetic Act irrespective of the official?s knowledge or involvement in the offense if the individual occupied a position that had a relationship with the unit that violated the statute, should have known about the activity, and had the authority to intervene. In short, the government need not produce evidence that the corporate official participated in or was aware of the illegal conduct. Potential penalties include fines, imprisonment, and debarment from the FDA.? As shall be discussed further, these penalties can lead to exclusion from Federal healthcare programs.

The Doctrine, which was first articulated by the Supreme Court in U.S. v. Dotterweich in 1943, was affirmed in 1975 in U.S. v. Park (and so sometimes referred to as the Park Doctrine).? The Dotterweich Court expounded on the rationale for imposing such a hardship on corporate defendants not actually involved in the illegal conduct: the welfare of unwitting consumers who have no ability to protect themselves against dangerous products and services must prevail over the hardship the Doctrine creates for the corporate executive with the position, responsibility and power to protect the public. The Park Court emphasized that guilt was not based solely on the defendant?s corporate position and explicitly recognized an affirmative defense where the defendant is ?powerless to prevent or correct the violation.?

The Doctrine has been rarely used, so fast forward to 2007, when the corporate entity Purdue Frederick pled guilty to a felony of misbranding along with the CEO, Chief Medical Officer and Chief Legal Officer who plead to misdemeanor misbranding pursuant to the Responsible Corporate Officer Doctrine. The convictions arose from Purdue Pharma?s off-label promotion of OxyContin, which the FDA approved in 1995 to manage chronic moderate to severe pain.? From 1995 until 2001, contrary to the package insert and evidence on the ground, a number of Purdue employees promoted OxyContin ?as less addictive, less subject to abuse and diversion, and less likely to cause tolerance and withdrawal,? as subject to fewer peak and trough blood level effects, and producing less euphoria than other pain short-action opioids. These representations apparently occurred in some instances at supervisors? urging, or as a result of sales training.

OxyContin became the number one prescribed Schedule II narcotic in the United States, with 5.8 million prescriptions in 2000.? OxyContin revenues reached approximately $3 billion in June 2001, accounting for 80% of Purdue Pharma?s revenue.? Despite its various troubles with OxyContin, Purdue Pharma never saw a dip in its revenues.? Effective August 9, 2010, Purdue discontinued manufacturing and distributing the original formulation, replacing it with an FDA-approved reformulation that is apparently more difficult for abusers to penetrate by cutting, breaking, crushing or dissolving.

OxyContin is an effective and efficient analgesic.? In addition to its legitimate use, however, OxyContin became very popular as a street drug, either taken orally, injected, or crushed, which circumvented the controlled release mechanism and allowed a more rapid and intense heroin-like high.?? The legal complications began when Appalachia experienced particular challenges with Oxy diversion, leading to criminal charges by the U.S. Attorney for West Virginia against what appears to have essentially been a shell corporation, Frederick Purdue, as well as three senior corporate officers.? Notably, Purdue Parma, L.P. which is the corporate entity that actually sells OxyContin as well as the company?s other pain medications, was not charged, thereby enabling it to continue to submit drug applications to the FDA and have its products paid for by the Federal healthcare programs.? Frederick Purdue and its executives agreed to plead guilty and pay fines totaling $634,515,475. Almost immediately, the HHS OIG used its discretionary exclusion power to debar all three executives from participating in Federal healthcare programs for twelve years.? The executives were unsuccessful in every level of administrative and judicial appeal. In retrospect, the Purdue Parma execs may feel relieved after hearing that three Synthes executives received multi-month prison terms in addition to their fines pursuant to the RCO Doctrine for their company?s conduct of unauthorized clinical trials of bone cement in which three patients died.

On the heels of this success, the FDA announced that it was increasing its use of misdemeanor prosecutions against responsible corporate officials.? The agency unveiled its internal agency guidance for determining when to forward a case to the Department of Justice for a "Park Doctrine Prosecution".? The guidance provides that a first time conviction for a violation of the FDCA will be a misdemeanor, with the second resulting in a felony.? Further, some misdemeanor convictions can result in debarment by the FDA.? Most importantly for this discussion, the guidance states that ?Knowledge of and actual participation in the violation are not a prerequisite to a misdemeanor prosecution but are factors that may be relevant when deciding whether to recommend charging a misdemeanor violation.?? The guidance enumerates the following additional criteria:

  • The individual?s position in the company; relationship to the violation; whether the official had the authority to correct or prevent the violation
  • Actual or potential harm to the public
  • Obviousness of the violation
  • Existence of a pattern of illegal behavior and/or failure to heed prior warnings
  • Whether the violation is widespread
  • Seriousness of the violation
  • Quality of the legal and factual support for the proposed prosecution
  • Whether prosecution is a prudent use of agency resources

Within the same week, Lewis Morris, Chief Counsel to the Inspector General of Health & Human Services testified before the House Ways and Means Committee that the OIG would review the case of any individual convicted pursuant to the RCO Doctrine for exclusion from participation in Federal healthcare programs.? This, Mr. Morris testified, will overcome the barriers presented by corporations? attitude that they are too important to the healthcare system to criminally prosecute and that fines are simply a cost of doing business.?? Mr. Morris assured the House Committee that the OIG would use this tool judiciously, employing a presumption in favor of exclusion only ?when there is evidence that an executive knew or should have known of the underlying criminal misconduct of the organization.?? The HHS OIG criteria for permissive exclusions from Federal healthcare programs includes a consideration of the entity?s misconduct, including whether it is part of a pattern of conduct and whether it caused harm to beneficiaries; the individual?s role in the sanctioned entity with a focus on degree of managerial control or authority and the position?s relation to the underlying misconduct and whether the misconduct occurred in the individual?s chain of command; and finally, detailed information about the nature of the sanctioned entity including its size, revenues, organization and structure.??

With this background, one wonders how the new RCO insurance policy would work in these cases????

The benefits of the policy include coverage for:

  • Defense costs incurred in the investigation or defense of any misdemeanor criminal proceeding, administrative proceedings brought pursuant to the RCO doctrine, as well as debarment proceedings.
  • Defense cost coverage for potential RCO claims.
  • Lost future compensation resulting from exclusion/debarment.
  • ?Recoupment loss? and/or clawback awards, which is the value of any compensation that must be returned or repaid by an insured person as a result of a judgment, decision, or settlement of an RCO claim.

An obvious omission from this list of benefits is the actual fines that are levied as part of the conviction, which are generally in the hundreds of millions. This is undoubtedly because insuring such risk would be against public policy.? Not mentioned on the web site, but revealed in an interview with the Philadelphia Inquirer is that policy exclusions ?might? kick in if evidence exists that the insured engaged in affirmative conduct that resulted in conviction. PharmaLot uncovered the same caveat in its interview with Jack Flug, a managing director at Marsh:? ?If the government decided the target knew what was going on and intentionally did something wrong, the coverage would cease. The intent factor is critical.?? Again, maybe dictated by public policy concerns.

But how will this work in practice?? Recall that the FDA?s Park Doctrine guidelines ? ?Knowledge of and actual participation in the violation are not a prerequisite to a misdemeanor prosecution but are factors that may be relevant when deciding whether to recommend charging a misdemeanor violation.?? DOJ will employ a presumption in favor of exclusion only ?when there is evidence that an executive knew or should have known of the underlying criminal misconduct of the organization.??? These criteria raise questions of just how the insurance company is going to ferret out evidence of intent, or whether it will use the language of these two government agencies to create its own presumption that intent exists once a conviction occurs, unless the insured can prove otherwise. Ultimately, there?s a real question of just how many payouts will actually be made under these new RCO policies.?

Another question, obviously, is whether prosecutors engaged in settlement negotiations will allow these insurance policies to be invoked.? U.S. v. Stein, the 2008 opinion in which the Second Circuit held that prosecutors? threat to indict KPMG if it paid its employees? legal fees violated the employees? Sixth Amendment rights to assistance of counsel, sheds one possible perspective on the outcome of this question.

Finally, the Marsh?s policy description does not mention covering directors, though one would have to imagine it would be willing to sell such a policy if so requested.? While it has yet to happen, , given their aggressive stance, that the FDA and OIG would not miss the opportunity, with the right facts, to? pursue the Responsible Officer Doctrine against a board member, perhaps on the Audit Committee.

A final twist: according to the Inquirer, upon learning of the new policy, Secretary of Health & Human Services Kathleen Sebelius replied, "I don't practice law on a regular basis, but usually you can't insure yourself as a bank robber for robbing banks. That is intriguing. I'd like a list of their customers because that would give us a pretty good target of people to go after."

The Author's Edge in Public Speaking - Matilija Press

I spoke yesterday at our famous outdoor bookstore in Ojai as part of the week-long Ojai Wordfest. Bart?s Books has been in existence for about 60 years. Used books are shelved in little alcoves surrounding a couple of large patio areas where you can sit and read or attend a book event. Some books are on shelves outside. When the store is closed, you can still purchase books. You just look at the price on the book and toss that amount over the fence onto the patio.

Today, I believe they have a slot where you put the money and it drops down into a can. I guess the new owners didn?t enjoy looking all over the cement each morning for coins.

One charm of Bart?s was the huge oak tree that grew up from the very center of the store. It had to be taken down a few years ago. It?s just not quite the same. I see that they have a resident cat, though. It seems that there was always a Bart the Cat wandering around the premises. Yesterday, I met Bart number 5 or 8 or 10?who knows?

My talk went okay. I got to talk about me?my journey as a career writer. I think I spread some inspiration around. A few people came up to me afterward to tell me that they felt inspired to follow their writing dreams and hoped they could be as committed as I was through the early years.

I had a friend ask me yesterday if I ever get nervous before a talk. I thought about it and responded this way:

?There is always the Gemini tendency to think and rethink and plan and consider and strategize and maybe worry a tad before a talk. No matter how well you plan for a presentation, there are still a lot of unknowns until you arrive at the venue.?

Yesterday, I arrived early, as I always do, and discovered that the metal chairs and tables were still very wet after the rainstorm the day before. I spent my prep time wiping them down with paper towels and pushing them out into the sun to further dry before guests arrived.

I told my friend, ?Some of the unknowns are not revealed until you actually get up in front of the group. You don?t know how many people will show up, whether they will be friendly, what they hope to get from you, etc. So I think I get a little nervous until I feel the energy coming from my audience. If it is positive, which 99.99 percent of the time it is, this will settle any uncertainties or nerves within me.

?I may be concerned that I can deliver what the audience wants. I try to squelch that concern by asking what they want. And I may experience some anxiety about being able to stay on track with my speech?you never know when your message will fall flat. Of course, that?s why you prepare, prepare, prepare and then give yourself permission to deviate from your speech if you see a need to.?

I remember once, tearing up my speech notes in front of an audience, tossing the pieces up in the air and letting them rain down on me. Once I got started, I realized that the audience wanted/needed something different from me than I was led to believe. So I improvised and it worked out very well.

I no longer feel nervous about going before a group, but I do shine brighter when I feel the group is friendly and are really interested in the information I am presenting.

So I told my friend, ?Nervousness?as in fear of speaking isn?t a problem for me, in most cases. But I think it is useful to be a little charged or stressed or on edge before speaking. It gives you a greater sense of energy. For me, I become more animated and energetic. And this, I think, energizes the audience and keeps them interested.?

Today, I?m speaking on another outdoor patio under a canopy of oaks. My talk title is ?Generating Revenue Through Writing.? I imagine I?ll have quite a few people there who are eager to get insider tips for making money with their writing. I hope they aren?t discouraged when I tell them, what you?ve been hearing from me in this blog for years, that it takes more than writing talent to make money in this industry.

I?ll let you know how attendees accept my message about dedication, commitment, motivation, tenacity, persistence and hard work.

Have you ordered my two latest books, yet? I sold some on the patio at Bart?s Books yesterday and have some packed up to take with me today, in case people are in the market for some seriously valuable information and guidance.
